Part of Creator studio equipment: the legal and ethical rules to check
Checking a studio equipment advert for disclosure, evidence and FCA boundaries
Check studio-equipment adverts for relationship disclosure, claim evidence, consumer information and FCA boundaries before release in the UK.
Use this checklist before publishing a UK studio-equipment promotion. It is an editorial control, not legal advice. A named advertising and consumer lawyer must decide the actual communication's status, and an FCA specialist must review any finance or credit element.
What to take away
- Record why the content exists, including payment, gifts and editorial control, before approving any script.
- Place the disclosure label where the audience first meets the commercial claim, not only in a biography.
- Match every objective claim to documentary evidence before publication, or narrow the words or hold the item.
- A clear ad label does not cure a false comparison, hidden cost or fabricated review.
- Submit any finance or credit element for FCA perimeter review, since CAP approval cannot replace that decision.
1. Record why the content exists
List payment, commission, affiliate links, gifted or loaned equipment, discounts, brand approval, ongoing appointments and own-brand interests. Also preserve the brief and messages that show editorial control. The relationship and content determine treatment, not the words review or tutorial.
The CAP Code's recognition section requires marketing communications to be obviously identifiable. Record the classification owner and their dated reason before the script is approved.
2. Design the disclosure for the real format
Put the approved label where the audience first meets the commercial claim. Test the post, video opening, thumbnail context, caption, transcript, audio-only route, small screen and any permitted excerpt. ASA social-media guidance explains why upfront, prominent identification matters and why a biography note alone may be inadequate.
A platform's paid-promotion control is a supplier feature. It should be tested as an extra mechanism, not recorded as UK legal clearance. Keep a screenshot or capture of the final rendering and the version that was distributed.
3. Match each claim to evidence
Create a claim row for compatibility, battery duration, sound quality, safety, accessibility, price, stock or comparative performance. State whether it is a supplier claim, a controlled observation or an editorial opinion. Section 3 of the CAP Code says objective claims capable of substantiation require documentary evidence before publication and material qualifications must not mislead.
Do not upgrade an unverified specification into test experience. Identify the exact model, firmware, setup, date, operator, sample and exclusions for any observation. If the evidence does not cover the headline, narrow the words or hold the item.
4. Check the consumer's decision
Review the whole impression, including visuals, price presentation, delivery, unavoidable charges, availability and calls to action. The CMA's unfair commercial practices guidance covers practices from 6 April 2025 under the Digital Markets, Competition and Consumers Act 2024, including misleading actions, omissions and specified review conduct.
For an invitation to purchase, identify the information the customer needs at that point. A clear ad label does not cure a false comparison, hidden cost or fabricated review.
5. Protect rights and separate finance
Keep licences for music, footage, photographs, logos and software demonstrations. The IPO's digital-images notice is official explanatory guidance, not permission to reuse an image. Appearance and location permissions need their own evidence.
If the content introduces instalments, hire purchase, leasing, insurance or another financial product, submit the exact words and journey for perimeter review. The FCA's financial promotions guidance states that product-specific rules may apply and promotions must be clear, fair and not misleading. CAP approval cannot replace that decision.
Release or hold
Release only when the relationship, disclosure render, claims, consumer information, rights, accessibility and any FCA gate have named owners and current evidence. Log later edits and reposts. Withdraw or correct the communication if a disclosure disappears, evidence expires, stock or price context changes, permission ends or the published configuration differs from the approved one.

- Create a claim row with evidence for each objective claim.
- Review the whole impression, including costs and availability.

- Submit any finance element for FCA perimeter review.
Common questions
What should be recorded before a studio-equipment promotion is approved?
List payment, commission, affiliate links, gifted or loaned equipment, discounts, brand approval, ongoing appointments and own-brand interests. Preserve the brief and messages showing editorial control. Record the classification owner and their dated reason before the script is approved, because the relationship and content determine treatment, not the words review or tutorial.
Where should the disclosure label go, and is a platform paid-promotion control enough?
Put the approved label where the audience first meets the commercial claim. Test the post, video opening, thumbnail context, caption, transcript, audio-only route, small screen and any permitted excerpt. A platform paid-promotion control is a supplier feature, so test it as an extra mechanism, not as UK legal clearance, and keep a capture of the final rendering.
When should a promotion be withdrawn or corrected?
Withdraw or correct the communication if a disclosure disappears, evidence expires, stock or price context changes, permission ends, or the published configuration differs from the approved one. Release only when the relationship, disclosure render, claims, consumer information, rights, accessibility and any FCA gate have named owners and current evidence, and log later edits and reposts.
